1. General Provisions

1.1. These Terms of Service (hereinafter — Terms or Offer) constitute a binding agreement between the Service Provider and any person who registers for or uses the Service.

1.2. The Service is owned and operated by Remote Genie AI, a company incorporated under the laws of Poland, with registered address at ul. Straganiarska 20/22/35 80-837 Gdansk (hereinafter — the Service Provider).

1.3. The Service Provider operates the online platform Remote Genie AI, available at https://remotegenie.ai (hereinafter — the Service).

1.4. Acceptance of these Terms is carried out by creating an Account or by otherwise using the Service. Creating an Account confirms that the User has read, understood, and fully agrees to these Terms and the Privacy Policy.

1.5. These Terms are mandatory for all Users.

2. Terms and Definitions

AccountA unique User account created in the Service, containing profile and job-preference data.
Job ListingA structured record of an employment opportunity indexed or curated by the Service, sourced from employers or third-party providers.
AI FeaturesTools and capabilities of the Service that operate based on artificial intelligence and automated data processing, designed to personalise job matching, recommend relevant opportunities, and improve job-search outcomes for the User.
SubscriptionA paid plan granting access to Service features for a defined Billing Period.
Billing PeriodThe recurring period for which a Subscription is charged, as selected by the User at the time of purchase (e.g., monthly or annual). The Billing Period applicable to a User's plan is confirmed at checkout and visible in Account settings.
Privacy PolicyThe Service Provider's data protection and privacy notice, available at https://remotegenie.ai/privacy, which governs the collection, use, and retention of personal data.

3. Subject of the Agreement

3.1. The Service provides Users with access to tools for searching jobs, saving job listings, browsing company profiles, receiving AI-powered job recommendations, and managing their job-search profile.

3.2. Account registration is available at no charge. Access to the Service's features requires a paid Subscription according to the plan selected by the User at https://remotegenie.ai/pricing.

4. Registration, Eligibility, and Account Use

4.1. To use the Service, the User must register, provide the required information, and confirm acceptance of these Terms and the Privacy Policy.

4.2. By registering, the User confirms they are at least 18 years of age. The Service is not intended for persons under 18. The Service Provider reserves the right to terminate any Account found to belong to a person under 18.

4.3. The User is obliged to provide accurate and up-to-date information. If any registered information changes, the User must update it promptly through Account settings.

4.4. All activity performed from a User's Account is considered the action of that User. The User is responsible for maintaining the confidentiality of their credentials and must notify the Service Provider immediately at [email protected] if they suspect unauthorised access to their Account.

4.5. Accounts are personal and non-transferable. The User may not sell, assign, sublicense, or otherwise transfer their Account or Subscription to any third party.

4.6. The User may request deletion of their Account at any time by contacting [email protected] or using the account deletion option in Account settings. Upon deletion, personal data is handled in accordance with the Privacy Policy and applicable law. Active Subscription access continues until the end of the paid Billing Period; no refund is issued for the remaining period.

5. Rights and Obligations of the Parties

5.1. The User has the right to:

  • Search job listings and browse company profiles.
  • Save job listings and set up job alerts.
  • Use AI Features to receive personalised job recommendations.
  • Manage their profile and job preferences.
  • Receive technical support within the capabilities of the Service.
  • Cancel their current Subscription or create a new one.
  • Exercise their data protection rights as described in Section 11.
  • Opt in to or opt out of marketing and newsletter communications at any time.

5.2. The User is obliged to:

  • Use the Service only for lawful purposes.
  • Not post false, misleading, or third-party-infringing information in their profile.
  • Comply with these Terms and the Privacy Policy.
  • Ensure valid payment details are maintained so that Subscription charges can be processed on the scheduled renewal date.
  • Not engage in scraping, crawling, or automated data extraction without prior written consent from the Service Provider.
  • Not attempt to gain unauthorised access to any part of the platform or its underlying infrastructure.
  • Ensure the confidentiality of their login credentials.
  • Promptly report suspected Account compromise to the Service Provider.

5.3. The Service Provider has the right to:

  • Temporarily restrict or permanently terminate the User's access in case of material violation of these Terms.
  • Make changes to the functionality of the Service, with at least 14 days' prior notice to Users for material changes.
  • Use anonymised or aggregated User data for analytics and improving the Service, in accordance with the Privacy Policy.
  • Delete the User's Account in case of material violation of clause 5.2.
  • Receive payment for paid Subscription plans.
  • Change Subscription tariffs with at least 30 days' prior notice to Users.
  • Send transactional messages, service notifications, and renewal reminders to the User's registered email address.

6. Job Listings, Employer Relationships, and Content Reporting

6.1. The Service indexes and curates job listings from employers and third-party providers. The Service Provider makes reasonable efforts to verify the accuracy and legitimacy of listings but does not guarantee that any listing is current, accurate, or that a position remains open.

6.2. The Service Provider is not a party to any employment relationship between the User and an employer. The Service Provider is not responsible for the conduct of employers or the outcome of any job application.

6.3. The User is responsible for independently verifying the details of any opportunity before applying.

6.4. If the User encounters a Job Listing they believe is illegal, fraudulent, discriminatory, or otherwise violates applicable law, they may report it to the Service Provider by emailing [email protected] with the URL of the listing and a brief description of the concern. The Service Provider will review reports and take appropriate action within a reasonable timeframe.

7. Payment, Subscriptions, and Right of Withdrawal

7.1. The Service offers paid Subscription plans. Subscriptions automatically renew at the end of each Billing Period until cancelled by the User. The Service Provider will send a renewal reminder to the User's registered email address at least 7 days before each scheduled renewal date.

7.2. Subscription pricing is published at https://remotegenie.ai/pricing. The Service Provider may change tariffs with at least 30 days' prior notice to Users. Price changes do not apply retroactively to an already-paid Billing Period.

7.3. Payment is processed by the Service Provider's payment processor (currently Stripe, Inc.; subject to change with prior notice to Users). The final amount charged may include applicable taxes. Stripe's own terms and privacy policy apply to payment processing.

7.4. If the User cancels auto-renewal, access to Service features remains active until the end of the already-paid Billing Period.

7.5. Payments for an already-started Billing Period are non-refundable, subject to clause 7.6 and any mandatory rights under applicable law.

7.6. Right of Withdrawal (EU/EEA Consumers)

Under the EU Consumer Rights Directive (2011/83/EU), consumers within the EU/EEA have the right to withdraw from a distance contract within 14 days without giving any reason (the “Withdrawal Period”).

However, for digital services where delivery begins immediately upon purchase, the right of withdrawal is lost once delivery has commenced, provided that:

  • the User gave express consent to begin delivery before the Withdrawal Period expired; and
  • the User acknowledged that the right of withdrawal would thereby be lost.

At the point of subscribing, the User will be presented with a clear checkbox confirming both of the above conditions. By ticking that checkbox and completing payment, the User expressly requests immediate access to the Service and acknowledges that the right of withdrawal is waived from that moment.

If the User does not consent to immediate delivery, delivery will begin only after the 14-day Withdrawal Period has expired. To exercise the right of withdrawal before immediate delivery commences, the User must contact [email protected] within the Withdrawal Period.

8. Liability of the Parties

8.1. The Service Provider does not guarantee employment and is not responsible for the actions of employers, recruiters, or third parties.

8.2. The User bears responsibility for the accuracy of profile data and any information submitted through the Service.

8.3. To the maximum extent permitted by applicable law, the Service Provider is not liable for indirect, incidental, or consequential loss including: loss of profit, expected savings, business opportunity, reputation, data, or loss of employment opportunity. Nothing in this clause limits the Service Provider's liability for damage caused by its own fraud, wilful misconduct, or gross negligence, or for any liability that cannot be excluded under mandatory applicable law.

8.4. The Service Provider is not liable for non-performance arising from events beyond its reasonable control, including but not limited to: internet or network failures, telecommunications outages, power failures, natural disasters, war, civil unrest, or acts of regulatory authorities.

8.5. In case the Service is used for fraud, distribution of spam, malware, or other illegal activities, the User is liable under applicable law and must compensate the Service Provider for any damages caused.

8.6. Liability Cap. To the maximum extent permitted by applicable law, the Service Provider's total cumulative liability to the User for any and all claims arising from or related to these Terms shall not exceed the total Subscription fees paid by the User in the 12 months preceding the event giving rise to the claim.

9. Intellectual Property

9.1. All rights to the software code, design, branding, and functionality of the Service belong to the Service Provider or its licensors and are protected by applicable intellectual property laws.

9.2. The User retains ownership of any content they submit to the Service (e.g., profile data). By submitting content, the User grants the Service Provider a non-exclusive, royalty-free licence to store, display to the User, and technically process that content solely for the purpose of providing the Service. This licence terminates when the User deletes their Account or the relevant content.

10. AI Features and Automated Processing

10.1. AI Features process the User's profile data, job preferences, and search behaviour to generate personalised job recommendations and rankings. This processing is carried out as part of delivering the Service under the contract between the User and the Service Provider (GDPR Article 6(1)(b)).

10.2. The personalised recommendations produced by AI Features are informational in nature. They do not constitute decisions with legal or similarly significant effects on the User within the meaning of Article 22 GDPR. The User remains free to apply to any job regardless of the Service's recommendations.

10.3. The User may request a review of how AI Features have been applied to their profile by contacting [email protected]. The Service Provider will respond within 30 days.

10.4. The User's personal data is not used to train publicly available AI models. Data used to improve the Service's recommendation algorithms is processed in pseudonymised form.

10.5. The Service Provider's AI recommendation system may be subject to obligations under the EU AI Act (Regulation 2024/1689). The Service Provider is monitoring applicable requirements and will update these Terms accordingly as obligations enter into effect.

11. Data Protection and Privacy

11.1. The Service Provider processes personal data in accordance with the Privacy Policy and applicable data protection law, including the General Data Protection Regulation (GDPR).

11.2. As a data subject under GDPR, the User has the following rights regarding their personal data held by the Service Provider:

  • Right of access (Art. 15) — Request a copy of the personal data held about you.
  • Right to rectification (Art. 16) — Request correction of inaccurate or incomplete data.
  • Right to erasure (Art. 17) — Request deletion of personal data where the conditions in Art. 17 GDPR are met.
  • Right to restriction (Art. 18) — Request that processing be restricted in certain circumstances.
  • Right to data portability (Art. 20) — Receive personal data in a structured, commonly used, machine-readable format.
  • Right to object (Art. 21) — Object to processing based on legitimate interests.
  • Right to withdraw consent — Where processing is based on consent, withdraw that consent at any time without affecting the lawfulness of prior processing.

11.3. To exercise any of the above rights, contact the Service Provider at [email protected]. Requests will be responded to within 30 days of receipt. The Service Provider may ask for identity verification before processing a request.

11.4. The User has the right to lodge a complaint with the supervisory authority in their country of residence. In Poland, the supervisory authority is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych — UODO).

12. Dispute Resolution and Governing Law

12.1. Disputes arising from these Terms shall first be referred to good-faith negotiations between the parties. Either party may initiate negotiations by sending a written notice describing the dispute and the resolution sought.

12.2. If no resolution is reached within 30 days of the notice in clause 12.1 (or such longer period as the parties may agree), the dispute shall be submitted to the exclusive jurisdiction of the competent courts of Poland, and these Terms shall be governed by the laws of Poland.

12.3. Notwithstanding clause 12.2, if the User is a consumer habitually resident in another EU/EEA member state, mandatory consumer protection provisions of that member state's law continue to apply regardless of this choice of law and jurisdiction. Such Users may also bring proceedings in the courts of their country of residence.

12.4. The European Commission provides an online dispute resolution platform for consumers at https://ec.europa.eu/consumers/odr, which the User may use as an alternative to court proceedings.

13. Term of the Offer and Amendments

13.1. These Terms take effect from the moment the User creates an Account or otherwise begins using the Service.

13.2. The User may cancel their Subscription at any time through Account settings or by contacting [email protected]. The Subscription automatically renews at the start of each new Billing Period until cancelled. To avoid renewal, the User must cancel before the scheduled renewal date. The renewal date is visible in Account settings.

13.3. These Terms are valid indefinitely from the moment of their publication on the website.

13.4. The Service Provider has the right to amend these Terms. Users will be notified of material changes at least 14 days before they take effect, via email and a prominent notice in the Service. Continued use of the Service after the effective date constitutes acceptance of the amended Terms. If the User does not accept material changes, they may cancel their Subscription before the effective date without penalty for the unexpired paid period.

14. General

14.1. Severability. If any provision of these Terms is found by a competent court to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

14.2. No Waiver. The Service Provider's failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision. Any waiver must be in writing to be effective.

14.3. Entire Agreement. These Terms, together with the Privacy Policy and the pricing published at https://remotegenie.ai/pricing, constitute the entire agreement between the Service Provider and the User regarding the Service and supersede all prior representations, agreements, or understandings, whether written or oral.

14.4. No Third-Party Beneficiaries. These Terms do not confer any rights on third parties.
